Terms of Service

Welcome to Home Service Pass. These Terms of Service ("Terms") govern your use of the Home Service Pass website, mobile application, and related services (collectively, the "Platform") operated by Home Service Pass, LLC ("HSP," "we," "us," or "our"). By accessing or using the Platform, you agree to be bound by these Terms.

1. Eligibility

You must be at least 18 years old and a resident of the United States to use the Platform. By creating an account, you represent and warrant that you meet these requirements and that all information you provide is accurate and complete.

2. Account Registration

To access certain features, you must create an account. You are responsible for:

  • Maintaining the confidentiality of your account credentials
  • All activity that occurs under your account
  • Notifying us immediately of any unauthorized use of your account

We reserve the right to suspend or terminate accounts that violate these Terms or are inactive for extended periods.

3. Home Service Pass Membership

Pass Purchase

The Home Service Pass is an annual membership that provides access to free services and exclusive member discounts from local service providers. Passes are non-transferable and tied to a single household address within our service area.

Service Area

The Platform currently serves Utah County, Utah. Services are only available within our supported ZIP codes. You can check coverage for your area during the purchase process.

Free Service Redemptions

Each pass includes a set of free services subject to the following rules:

  • Free services are limited to one redemption per service per year per pass
  • Free services must be redeemed during the active pass period
  • Unused free services do not carry over to a renewed or new pass
  • Services are performed by independent providers in our network and are subject to provider availability

Member Discounts

Pass holders receive exclusive discounts on additional services beyond their free redemptions. Discount amounts vary by service and provider. Discounts cannot be combined with other promotions unless explicitly stated.

4. Payments and Refunds

Payment Processing

All payments are processed securely through Stripe. By making a purchase, you agree to Stripe's Terms of Service. We accept major credit and debit cards.

Refund Policy

We offer a 30-day refund policy from the date of purchase, subject to the following conditions:

  • Full refund— available within 30 days of purchase if no free services have been redeemed
  • No refund— if any free service has been redeemed, the pass is considered used and is non-refundable
  • Pro-rated refunds— not available. Passes are sold as annual memberships

To request a refund, contact us at support@homeservicepass.com within the 30-day window.

Pass Renewal

Passes do not auto-renew. When your pass expires, you will receive email reminders and may purchase a new pass at the current price. If you have an active subscription service (such as recurring pet waste removal), your subscription may be paused upon pass expiration.

5. Subscription Services

Certain services on the Platform operate on a recurring subscription basis (e.g., weekly or biweekly pet waste removal). Subscription services require:

  • An active Home Service Pass
  • A valid payment method on file
  • An address within the service coverage area

Subscription billing details:

  • Billing begins after your first service is completed and recurs monthly
  • Pass holders receive a member discount on subscription pricing for the first 6 months
  • You may pause or cancel your subscription at any time through the app
  • If your pass expires, your subscription will be automatically paused until the pass is renewed

6. Bookings and Service Delivery

Booking Process

When you request a service through the Platform, the assigned provider will review your request, provide a quote (if applicable), and schedule the service. You will be notified at each step.

Provider Relationship

Service providers on the Platform are independent contractors, not employees of Home Service Pass. We vet providers for licensing, insurance, and quality, but we do not directly control how services are performed. HSP is not liable for the quality, timeliness, or outcome of any service.

Cancellations

You may cancel a booking before it is scheduled without penalty. Cancellations after scheduling may be subject to the provider's cancellation policy. Repeated no-shows may result in account restrictions.

7. User Conduct

When using the Platform, you agree not to:

  • Provide false or misleading information in your account or bookings
  • Use the Platform for any unlawful purpose or in violation of any applicable law
  • Harass, abuse, or threaten service providers or other users
  • Attempt to circumvent the Platform to engage providers directly and avoid applicable fees
  • Share your pass code or account credentials with others
  • Use automated tools, bots, or scripts to access the Platform
  • Submit false reviews, ratings, or dispute claims
  • Interfere with the operation or security of the Platform

Violation of these rules may result in immediate account suspension or termination.

8. Intellectual Property

All content on the Platform, including text, graphics, logos, icons, images, and software, is the property of Home Service Pass, LLC or its licensors and is protected by copyright, trademark, and other intellectual property laws. You may not reproduce, distribute, or create derivative works from any content without our prior written consent.

9. Limitation of Liability

To the maximum extent permitted by law, Home Service Pass, LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Platform, including but not limited to:

  • Damages resulting from services performed by independent providers
  • Loss of data, revenue, or profits
  • Service interruptions or Platform downtime
  • Unauthorized access to your account

Our total liability for any claim arising from these Terms or your use of the Platform shall not exceed the amount you paid for your most recent Home Service Pass.

10. Indemnification

You agree to indemnify, defend, and hold harmless Home Service Pass, LLC, its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including reasonable attorney fees) arising from your use of the Platform, violation of these Terms, or infringement of any third-party rights.

11. Dispute Resolution

Service Disputes

If you have a dispute regarding a service, please use the in-app dispute reporting feature or contact us at support@homeservicepass.com. We will work with you and the provider to reach a fair resolution, which may include credits, rebooking, or refunds.

Legal Disputes

Any legal disputes arising from these Terms shall be resolved through binding arbitration in Utah County, Utah, under the rules of the American Arbitration Association. You agree to waive your right to participate in a class action lawsuit or class-wide arbitration. Each party bears its own legal costs unless otherwise awarded.

12. Modifications to Terms

We may update these Terms from time to time. When we make material changes, we will notify you by updating the "Last updated" date at the top of this page and, for significant changes, by email. Your continued use of the Platform after changes take effect constitutes acceptance of the revised Terms.

13. Governing Law

These Terms are governed by the laws of the State of Utah, without regard to conflict of law principles. Any legal proceedings shall be conducted in the courts of Utah County, Utah.

14. Termination

We may suspend or terminate your account at any time for violation of these Terms or for any other reason at our sole discretion. Upon termination:

  • Your access to the Platform will be revoked
  • Any unused free services on your pass will be forfeited
  • Active subscriptions will be canceled
  • Outstanding payments owed to you (e.g., credits) will be processed within 30 days
